Terms and Conditions
Effective Date: August 9, 2026
These Terms and Conditions ("Terms") are a binding agreement between you and GoldPen Realty Group, operating GoldPen Intelligence ("GoldPen Intelligence," "we," "us," or "our") governing your access to and use of the AI Generator, Documents Analyzer, Mortgage Calculator, and related features (collectively, the "Services"). By signing in or using any tool on the Services, you agree to these Terms and our Privacy Policy.
Acceptance of these general Terms does not by itself authorize us to create an AI avatar, synthetic voice, or voice clone of you. That feature requires the separate express consent presented before you record your reference video.
1. Eligibility
The Services are available only to authorized agents and staff of GoldPen Realty Group, GoldPen Finance, GoldPen Title Experts, and other affiliated GoldPen brands, and only to individuals at least 18 years old.
2. Your Account
You are responsible for maintaining the confidentiality of your credentials and for all activity performed through your account. Notify us immediately at office@goldpengroup.com if you suspect unauthorized use.
3. The Services
We may improve, replace, suspend, or discontinue a feature at any time. We do not guarantee uninterrupted availability - maintenance, vendor outages, or events outside our control may affect the Services.
4. Not Professional Advice
Content and output from the Services - including document analysis and mortgage estimates - are provided for informational purposes only. They do not constitute legal, tax, financial, or appraisal advice, an underwriting decision, or a commitment to lend. You should consult an appropriately licensed professional before relying on information that may affect a financial, legal, or real-estate decision.
5. License to Use the Services
We grant you a limited, personal, non-exclusive, non-transferable license to use the Services for your own professional work as a GoldPen agent. You may not copy, distribute, reverse engineer, or create derivative works from the Services themselves without our written permission.
6. Your Content and Consent to AI Processing
When you upload a photo, video, or document, you confirm that it is your own likeness and voice, or a document you have the right to share, and you consent to it being processed by our AI service providers to generate your voice clone, avatar video, document analysis, or calculation results. You retain ownership of the content you upload and of the videos generated for you; you grant us only the limited license needed to host, process, and deliver that content back to you.
7. AI-Generated Content Disclaimer
AI output may be inaccurate, incomplete, or inconsistent with your input, and an avatar or synthetic voice may not perfectly reproduce your appearance or voice. You are responsible for reviewing any generated video, script, or document analysis before sending it to a client or relying on it professionally. Nothing produced by the Services is legal, financial, or professional advice.
8. Mortgage Calculator and Documents Analyzer
Calculator results are estimates based on the inputs and assumptions you provide - actual payments, rates, taxes, insurance, and qualification may differ, and no result is a commitment to lend, loan estimate, or appraisal. Documents Analyzer output is a summary to help you review a document faster; it is not a substitute for your own reading of the document or for advice from a licensed attorney or professional where appropriate.
9. Prohibited Uses
You agree not to use the Services to:
- Create a voice clone or avatar of anyone other than yourself without their consent
- Upload content you do not have the right to use
- Generate content that is unlawful, misleading, discriminatory, or infringes another person's rights
- Attempt to circumvent credit limits, account restrictions, or platform security
- Access accounts, systems, or data without authorization
10. Intellectual Property
The Services and their underlying technology are owned by GoldPen Realty Group or its licensors. Except for the limited license above, no rights are granted to you.
11. Third-Party Services
The Services interoperate with providers such as Zoho, ElevenLabs, and Runway to deliver CRM, voice cloning, and video generation functionality. Their services are governed by their own terms and privacy notices, and we are not responsible for their independent acts or outages.
12. Termination
We may suspend or terminate your access if you violate these Terms, misuse the Services, or are no longer affiliated with a GoldPen brand.
13. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE UNINTERRUPTED OR ERROR-FREE OPERATION OR AI OUTPUT.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOLDPEN REALTY GROUP AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM THE SERVICES, INCLUDING RELIANCE ON ANY AI-GENERATED CONTENT. OUR AGGREGATE LIABILITY ARISING FROM THE SERVICES WILL NOT EXCEED USD $100.
15. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless GoldPen Realty Group and its affiliates, officers, employees, and contractors from third-party claims arising from your unlawful content, misuse of the Services, or material breach of these Terms.
16. Force Majeure
We are not liable for delay or failure caused by events beyond our reasonable control, including natural disasters, government actions, cyberattacks, vendor outages, or internet disruptions.
17. Informal Dispute Resolution
Before filing a claim, you agree to first contact us at office@goldpengroup.com and describe the dispute. We will attempt in good faith to resolve the matter for 30 days before either party files a claim, except for claims seeking urgent injunctive relief.
18. Arbitration and Class-Action Waiver
Except for eligible small-claims matters or claims seeking urgent injunctive relief, disputes that cannot be resolved informally will be resolved through binding individual arbitration administered by the American Arbitration Association under the Federal Arbitration Act, taking place in Miami-Dade County, Florida, or remotely when permitted. Claims must be brought individually - neither party may participate in a class, collective, or representative action. You may opt out of this arbitration provision by emailing office@goldpengroup.com within 30 days of first accepting these Terms.
19. Governing Law
These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law principles, except that the Federal Arbitration Act governs Section 18.
20. Changes to These Terms
We may update these Terms from time to time. Continued use of the Services after changes take effect means you accept the updated Terms.
